1.2. Scope: These Terms and Conditions govern the sale and purchase of customisable LED mood lamps and related products and accessories through our website located at https://www.jaim.uk/. By placing an order on our Website, you agree to be bound by these Terms.
1.3. Consumer Rights: These Terms do not affect your statutory rights as a consumer under UK law, including your rights under the Consumer Rights Act 2015 and the Consumer Contracts (Information, Cancellation and Additional Charges) Regulations 2013.
2. Product Information
2.1. Product Descriptions: We take reasonable care to ensure that all details, descriptions, and prices of Products appearing on the Website are correct at the time of publication. However, descriptions may vary slightly due to manufacturing changes or technological advancements.
2.2. Images: Product images are for illustrative purposes only. While we try to display colours accurately, we cannot guarantee that a device's display of the colours accurately reflects the true colour of the Products. Your Products may vary slightly from those images.
2.3. Specifications: Key specifications will be provided on individual product pages. It is your responsibility to ensure the Product is suitable for your intended use.
2.2. Stock Availability: All orders are subject to stock availability. If a Product is out of stock after you have placed an order, we will inform you as soon as possible and offer an alternative or a full refund.
3. Pricing and Payment
3.1. Prices: All prices displayed on the Website are in Great British Pounds (GBP) and include VAT at the current UK rate, where applicable.
3.2. Delivery Charges: Delivery charges are not included in the Product price and will be added to your order total during the checkout process. These will be clearly displayed before you confirm your purchase.

4. Ordering Process and Contract Formation
4.1. Placing an Order: You can place an order by selecting Products on our Website and proceeding to checkout. You will be guided through the process of providing your details and payment information.
4.2. Order Confirmation: After placing an order, you will receive an email from us acknowledging that we have received your order. This email does not mean that your order has been accepted.
4.3. Acceptance of Order (Formation of Contract): Our acceptance of your order takes place when we dispatch the Products to you, at which point a contract will come into existence between you and us. We will send you a dispatch confirmation email.
4.4. Refusal of Order: We reserve the right to refuse any order for any reason, including but not limited to, suspected fraud, inability to obtain authorisation for payment, or if the Product is out of stock.
5. Delivery
5.1. Delivery Times: We aim to deliver Products within [e.g., 3-5 working days] of dispatch, unless otherwise specified. Estimated delivery dates are not guaranteed and are subject to change.
5.2. Delivery Costs: Delivery costs will vary depending on the size and weight of your order and your delivery location. These will be clearly displayed at checkout.
5.3. Delivery Method: Products will be delivered by Royal Mail 48 tracked or DPD.
5.4. Risk of Loss: The Products will be at your risk from the time of delivery. You own the Products once we have received payment in full, including all applicable delivery charges.
5.5. Undeliverable Items: If delivery is attempted and unsuccessful, the courier may leave a calling card with instructions for redelivery or collection. If Products are returned to us due to repeated failed delivery attempts, we reserve the right to charge for redelivery or deduct original shipping costs from any refund.
5.6. Late Delivery: Unless expressly agreed otherwise, we will deliver the Products within 30 days. If we fail to deliver within 30 days (or the agreed period) and time was of the essence for your order, you may be entitled to cancel the contract and receive a full refund.
6. Your Right to Cancel (Consumer Contracts Regulations 2013)
6.1. Cooling-Off Period: As a consumer, you have the right to cancel your contract with us within 14 days without giving any reason. The cancellation period will expire after 14 days from the day on which you acquire physical possession of the Products. If you ordered multiple items that are delivered separately, the 14-day period begins when you receive the last item.
6.2. How to Cancel: To exercise the right to cancel, you must inform us of your decision by a clear statement (e.g., a letter sent by post, email).

6.3. Effects of Cancellation: If you cancel this contract, we will reimburse to you all payments received from you, including the costs of delivery (with the exception of the supplementary costs arising if you chose a type of delivery other than the least expensive type of standard delivery offered by us).
6.4. Deductions from Reimbursement: We may make a deduction from the reimbursement for loss in value of any Products supplied, if the loss is the result of unnecessary handling by you (i.e., handling beyond what is necessary to establish the nature, characteristics, and functioning of the Products).
6.5. When Reimbursement Will Be Made: We will make the reimbursement without undue delay, and not later than:
a) 14 days after the day we receive back from you any Products supplied, or
b) (if earlier) 14 days after the day you provide evidence that you have returned the Products, or
c) if there were no Products supplied, 14 days after the day on which we are informed about your decision to cancel this contract.
6.6. Return of Products after Cancellation: You must send back the Products or hand them over to us without undue delay and in any event not later than 14 days from the day on which you communicate your cancellation from this contract to us. The deadline is met if you send back the Products before the period of 14 days has expired.
6.7. Cost of Returning Products: You will be responsible for all return shipping charges, We strongly recommend that you use a trackable method to mail your return.
7. Returns for Faulty or Non-Conforming Products (Consumer Rights Act 2015)
7.1. Your Rights: Under the Consumer Rights Act 2015, all Products must be of satisfactory quality, fit for purpose, and as described.
7.2. Reporting Faults: If you believe a Product is faulty or not as described, please contact us immediately upon discovery at returns@jaim.uk with your order number
7.3. Remedies:
Within 30 days of delivery: If a Product is faulty within 30 days of delivery, you are entitled to a full refund.
After 30 days (up to 6 months): If a fault develops after 30 days but within 6 months of delivery, we will first offer a repair or replacement. If the repair or replacement is unsuccessful or impossible, you are entitled to a full refund (which may be reduced if you have had significant use of the Product).
After 6 months: After 6 months, you must prove that the fault was present at the time of delivery. We will still offer a repair or replacement, and if that is not possible, a partial refund.
7.4. Return of Faulty Products: We will bear the cost of returning faulty or non-conforming Products to us. We will provide instructions on how to return the item.
7.5. Assessment: We may inspect returned Products to verify the fault. If no fault is found, we may charge you for the return shipping costs.
8. Limitation of Liability
8.1. Our Responsibility: We are responsible for loss or damage you suffer that is a foreseeable result of our breach of these Terms or our negligence, but we are not responsible for any loss or damage that is not foreseeable.
8.2. Statutory Rights: Nothing in these Terms limits or excludes our liability for:
a) death or personal injury caused by our negligence;
b) fraud or fraudulent misrepresentation;
c) any breach of the terms implied by section 12 of the Sale of Goods Act 1979 or section 2 of the Supply of Goods and Services Act 1982 (title and quiet possession);
d) defective products under the Consumer Protection Act 1987; or
e) any other liability which cannot be limited or excluded by applicable law.
8.3. Indirect/Consequential Loss: We are not liable for any indirect or consequential loss or damage, including but not limited to loss of profit, loss of business, business interruption, or loss of business opportunity. For example, we are not liable for any electrician fees incurred due to late delivery or a faulty product where you scheduled an installation prior to receiving and checking the product.
8.4. Force Majeure: We will not be liable or responsible for any failure to perform, or delay in performance of, any of our obligations under these Terms that is caused by events outside our reasonable control ("Force Majeure Event").
9. Waste Electrical and Electronic Equipment (WEEE) Regulations
9.1. Our WEEE Obligations: As a retailer of Electrical and Electronic Equipment (EEE), we comply with the UK WEEE Regulations.
9.2. Recycling: We are registered with a producer compliance scheme to meet our obligations.
9.3. Disposal: Please do not dispose of WEEE (including LED lamps) in your general household waste. Look for the crossed-out wheelie bin symbol. Recycle responsibly at designated collection points or through local authority schemes.
10. Intellectual Property
10.1. Ownership: All content on this Website, including text, graphics, logos, images, and software, is our property or licensed to us and is protected by UK and international copyright laws.
10.2. Use of Content: You may not reproduce, duplicate, copy, sell, resell, or exploit any portion of the Website without our express written permission.

12.3. Online Dispute Resolution (ODR) Platform: The European Commission provides an online dispute resolution platform (ODR platform) for consumers and traders, though the UK is no longer in EU, this platform can still be used for cross-border disputes with EU traders].
13. General
13.1. Entire Agreement: These Terms constitute the entire agreement between you and us in relation to your purchase of Products.
13.2. Severability: If any provision of these Terms is deemed unlawful, void, or for any reason unenforceable, then that provision shall be deemed severable from these Terms and shall not affect the validity and enforceability of any remaining provisions.
13.3. Waiver: Any waiver by us of a breach of any provision of these Terms shall not be considered as a waiver of any subsequent breach of the same or any other provision.
13.4. Governing Law and Jurisdiction: These Terms are governed by and construed in accordance with the laws of England and Wales. You and we both agree that the courts of England and Wales will have exclusive jurisdiction to resolve any disputes arising from these Terms, although if you are a resident of Northern Ireland you may also bring proceedings in Northern Ireland, and if you are a resident of Scotland, you may also bring proceedings in Scotland.
